NASSAU, BAHAMAS- Attorneys for Lubert Adler-Old Bahama Bay (LRA-OBB) have asserted that the management company, Island Ventures Resort and Club (IVRC), must vacate Old Bahama Bay immediately, warning that legal recourse will follow if the handover is not executed.
Attorney Michael Scott KC told Eyewitness News on Sunday, “They will be leaving! Their license, which is all they have, is terminated!” Scott indicated that if they resist, legal action would “naturally” follow.
An eviction notice was served to Old Bahama Bay Resort’s managing company, IVRC, in February of this year, instructing them to vacate the property by March 28th. However, John MacDonald, president of Island Ventures Resort and Club (IVRC), the entity formed by the 73 condo owners to keep the hotel open following Ginn’s 2011 default, reportedly remains firm in his stance that IVRC “will not be vacating said premises” and vowed to resist any moves to oust them.
It remains to be seen how this battle will play out and reach its ultimate conclusion. MacDonald warned that IVRC would involve the police and launch Supreme Court legal action, accusing LRA-OBB of inflicting “emotional distress” on over 100 staff members, vendors, and condo owners due to the uncertainty surrounding the management takeover.
However, in a March 26, 2025, letter to IVRC’s legal representatives, Scott indicated that IVRC’s failure to smoothly hand over Old Bahama Bay despite receiving more than the required four weeks’ notice of the termination of their license was responsible for the “chaos and discord” now occurring. He pointed out that IVRC had been granted a ‘bare licence’—not a lease—to operate Old Bahama Bay, including its marinas, restaurants, and other facilities, and demanded that IVRC fulfill its legal employer obligations.
